Terms & Conditions
At Benarty Carpets & Flooring, we pride ourselves on being a friendly, family-run business built on trust, honesty, and good communication. These terms are here to explain what you can expect from us and what we ask from our customers when placing an order.
Nothing within these terms affects your statutory rights under the Consumer Rights Act 2015.
Orders & Payments
A deposit is required when accepting your quotation. This covers the cost of materials, and goods will only be ordered once payment has been received.
Any delay in paying your deposit may affect provisional fitting dates already discussed.
The remaining balance must be paid in full before fitting or installation unless otherwise agreed in writing.
Commercial invoices must be settled within agreed payment terms. We reserve the right to charge interest and recovery costs on overdue commercial accounts where applicable.
All goods supplied remain the property of Benarty Carpets & Flooring until paid for in full.
Cancellations & Returns
If you need to cancel your order, please contact us as soon as possible.
Where goods have already been ordered, dispatched, or cut specifically to size, they may be non-returnable and costs may be deducted from any advance payments made.
For supply-only purchases, returns are only accepted where goods are faulty.
Fitting & Installation
All installations are carried out by experienced professional subcontracted fitters.
While we always aim to meet agreed fitting dates and times, delays can occasionally occur due to circumstances beyond our control. If we ever need to rearrange an appointment, we will contact you as early as possible to arrange an alternative date.
Your quotation will clearly state what is included within your installation. Services such as furniture moving, uplift and disposal of old flooring, appliance removal, or door easing are only included where specifically stated and may incur additional charges.
Subfloor Preparation
We always try to assess the condition of your subfloor before installation begins. However, the full condition cannot always be confirmed until the existing flooring has been removed.
Occasionally, additional preparation work or materials may be required due to unforeseen issues beneath the existing floor. Should this happen, we will discuss everything with you before carrying out any extra work.
Where smoothing compounds or floor preparation products are installed, these works are carried out in line with manufacturer recommendations and relevant British Standards.
Due to uneven walls, existing floors, previous installation work, or natural movement within a property, small gaps around skirting boards, trims, kitchens, or fixtures may occasionally become visible after installation.
Unless specifically stated within your quotation, cosmetic finishing works are not included.
Customer Responsibilities
Please inform us in advance of any known pipes, cables, underfloor heating systems, or electrical services beneath the subfloor.
We cannot accept responsibility for damage to hidden services where we have not been made aware beforehand.
Unless agreed otherwise, rooms should be cleared of furniture and existing floor coverings prior to fitting. Kitchen appliances and electrical goods should also be disconnected and removed before installation.
Where we assist with moving furniture, we cannot accept responsibility for accidental damage or breakages.
Existing Decor & Property Conditions
Flooring installation can be an intensive process and, while every care is taken to protect your home, minor marks or scuffs to walls, skirting boards, or décor can occasionally occur.
If you have recently redecorated, some touch-up work may be required afterwards.
Our fitters carry appropriate insurance should any significant damage occur as a direct result of negligence.
Guarantees & Aftercare
Our fitting workmanship is guaranteed for 12 months from the installation date.
If we are asked to inspect an issue that is found not to be related to the original installation, a call-out charge plus any associated repair costs may apply. Any charges will always be discussed beforehand.
We recommend all flooring is maintained in accordance with the manufacturer’s care guidelines.
Steam mops should never be used on any flooring product regardless of claims made by steam mop manufacturers.
If any issues arise following installation, please report them to us as soon as possible.
Product Information
Samples displayed in-store are representative only and slight variations in colour, texture, or finish may occur within accepted manufacturing tolerances.
Soft floor coverings may naturally show shading, flattening, or pile pressure over time. This is a normal characteristic of textile flooring and does not affect product quality or lifespan.
Liability
We cannot be held responsible for damage or issues arising after installation where other tradespeople are still working onsite or where furniture is moved back into place following fitting.
Privacy
We take your privacy seriously and only use your information to manage quotations, invoices, and installation arrangements.
Your details may be shared with subcontractors where necessary to complete agreed works or communicate directly regarding your installation.
Governing Law
These Terms & Conditions are governed by the laws of Scotland and any disputes shall be subject to the jurisdiction of the Scottish courts.
